1. Report Problems Promptly
Customers should inspect goods at delivery when reasonably possible and report apparent loss or damage promptly. Prompt notice helps preserve evidence but does not shorten any non-waivable statutory or contractual filing period.
2. Preserve Evidence
Do not discard allegedly damaged items, packaging, shipping materials, photographs, receipts, serial numbers, purchase records, repair estimates, inventory lists, delivery documents, or other evidence until the claim is resolved or NoxMove confirms inspection is unnecessary.
3. Claim Submission
A complete claim should identify the shipment, date, customer, affected item, nature of loss/damage, amount claimed, supporting valuation, photographs, and supporting documents. NoxMove may request additional information reasonably necessary to investigate.
4. Investigation
NoxMove may review shipment records, photographs, communications, condition notes, route data, packaging, witness information, and applicable carrier documents. Investigation does not constitute an admission of liability.
5. Measure of Liability
The amount payable, if any, is determined by applicable law and the shipment’s governing documents, including any lawful released-value or valuation election. A customer’s declared retail value does not automatically establish carrier liability.
6. Exclusions and Contributing Causes
Depending on applicable law and the transportation contract, liability may be affected by inadequate customer packing, inherent vice, concealed damage, ordinary wear, acts of public authority, acts of God, customer loading, undisclosed fragility, or other legally recognized defenses. NoxMove does not rely on an exclusion where law makes liability non-waivable.
7. Salvage and Repairs
NoxMove may request an opportunity to inspect, repair, replace, or obtain salvage credit where lawful and commercially reasonable. Customers should not dispose of claimed property without preserving evidence and giving a reasonable inspection opportunity, unless disposal is necessary for safety.
8. Time Limits
Do not rely on this website for a filing deadline. Claim and lawsuit deadlines can differ by shipment type and governing law. The bill of lading, tariff, transportation contract, and applicable federal or state rules control.
9. No Waiver by Discussion
Customer-service communications, inspection, settlement discussions, or requests for information do not waive a valid defense, limitation, or deadline unless expressly confirmed in a signed writing or required by law.
10. Claim Decisions
NoxMove should provide a written decision or settlement communication after reasonable investigation. Any settlement may require a lawful release specific to the claim.
